SCOPE, AGE & APPLICATION 

These Terms and Conditions (hereinafter referred to as the Terms) shall apply to the use of the website of www.small-wonder.dk (hereinafter referred to as the Website) and all purchases of products, including without limitation, hereinafter referred to as the Products) which are sold through this Website from Small Wonder ApS (hereinafter referred to as us, we, our or Small Wonder) to you (hereinafter referred to as you, your or the Customer).

All Customers under the age of 18 must obtain prior permission to buy Products from the Website from a parent or legal guardian. 

IF YOU DO NOT AGREE TO ABIDE BY THESE TERMS, YOU MUST LEAVE THIS WEBSITE.

OFFER, ACKNOWLEDGEMENT & ACCEPTANCE

Any prices, quotations and descriptions made or referred to on this Website are subject to availability, do not constitute an offer and may be withdrawn or revised at any time prior to our express acceptance of your order (as described below).

While we make every effort to ensure that Products appearing on the Website are available, we cannot guarantee that Products at all times are in stock or immediately available when you submit your order. We may reject your order (without liability) if we are unable to process or fulfil it and we reserve the right to refuse orders for any reason without explanation. If this is the case, we will refund any prior payment that you have made for that Product.  

An offer submitted by you constitutes an offer by you to us to purchase Products on these Terms and is subject to our subsequent acceptance.

Prior to such acceptance, an automatic e-mail acknowledgement of your order may be generated. Please note that any such automatic acknowledgement does not constitute a formal acceptance of your order.

Our acceptance of your order takes effect and the contract is concluded at the point where such offer is expressly accepted by us dispatching your order and accepting your credit card or other payment (hereinafter referred to as Acceptance).

DELIVERY, SHIPPING & RISK 

At this time SMALL WONDER will be shipping to all countries/locations with the exception of; United Kingdom (for orders above 180 EUR, please reach out), Russia, Belarus, Ukraine, Africa, Belize, Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama, Peru, Venezuela, Ecuador, Bolivia, Paraguay, Uruguay, Guyana, Suriname, French Guiana, Falkland Islands, Iran, Iraq (hereinafter referred to as the Territory).

Limited tracking is available to the following countries: Brazil, Iceland, Japan, Luxembourg, Norway, Switzerland. Orders made from these countries will include tracking until export from the USA. Once exported, tracking is not available for these orders.

Delivery times vary from country to country, but all orders are shipped (subject to availability) within 1-3 business days. During new Product releases, shipping times may be delayed (without liability).

Shipping and delivery times are estimates only. While we endeavour to meet such timescales or dates, we do not undertake to dispatch Products of a particular date or dates and shall not be liable to you in respect of delays or failure to do so.

Delivery shall be to a valid address within the Territory and subject to our Acceptance (hereinafter referred to as the Delivery Address). You must check the Delivery Address on any acknowledgement or acceptance we provide and notify us without delay of errors or omissions. We reserve the right to charge you for any extra costs arising from changes you make to the Delivery Address after you submit an order.

All orders are shipped with Fedex, USPS or DHL. All other shipping prices vary.

The risk of loss of or damage to the Products shall pass to you on delivery or when placed in your possession or that of any carrier or transport provided by you, whichever shall occur first (hereinafter referred to as Delivery).  

LIABILITY

Small Wonder cannot in any event be held liable in damages for any use of this Website, including for loss of income, business interruptions, loss of data, operational failures or similar losses.

Any claims for damages against us, including, without limitation, punitive, indirect, special, incidental, consequential and any claim raised under the rules on product liability, shall never exceed the amount invoiced by us to you for the Product in question, irrespective of the nature of the claim, whether in contract, tort, warranty or otherwise.

Certain links, including hypertext links, on the Website will take you outside the Website. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked site, its operator or its content. We are not responsible for the content of any website outside our site.

COPYRIGHT AND TRADEMARKS 

All Products and all content and infrastructure of the Website including graphics, logos, text, images, sound files, videos etc. are property of Small Wonder and are copyright protected. Images on this Website are incorporated for viewing purposes only and may not be saved or downloaded in any format.

Unauthorized reproduction, distribution or public display of such Products, trademarks or any intellectual property of Small Wonder may result in civil and criminal sanctions.

RETURN POLICY

Small Wonder accepts returned Products in perfect unopened and unused condition. For the avoidance of doubt, Products and playing cards may not be returned if the seal is broken. Products must be shipped back no later than 15 days from Delivery. Returned items must be shipped using a carrier providing tracking information. Proof of delivery to Small Wonder must be provided before any refunds will be issued. Small Wonder will not cover any costs related to returning Products purchased at the Website. Refunds are issued no later than 7 business days after items are returned to Small Wonder.  

PURCHASE FOR PERSONAL USE ONLY

You may purchase Products only for personal use and not for resale. By placing your order, you certify that you are purchasing Products for personal use only and not for resale. We reserve the right to refuse orders for any reason without explanation.

PAYMENT, CUSTOM DUTIES AND EXPORT VAT 

Small Wonder currently accepts the following form of payment:

COMPLAINTS

If you, as a Customer, find that our Product has not lived up to our agreement or your expectations, please present your complaint to Small Wonder. If, subsequently, you wish to file a formal complaint about the Product in question, please address your complaint to Nævnenes Hus, Mæglingsteamet for Forbrugerklager, Toldboden 2, 8800 Viborg via Klageportalen for Nævnenes Hus. Please note that the purchase price of the Product you wish to complain about needs to be at least DKK 1,100 - or DKK 720 if the Product in question is clothes – and that filing a complaint is subject to payment of a fee. 

The EU Commission’s online complaints portal may also be used to file a complaint. This channel is particularly relevant if you are a consumer residing in another EU Member State. Complaints are filed via www.ec.europa.eu/odr (http://www.ec.europa.eu/odr).

GOVERNING LAW AND VENUE

Any dispute arising out of or in connection with purchase of Products on the Website, shall be settled in accordance with the substantive laws of Denmark, except for the United Nations Convention on Contracts for the International Sale of Goods (CISG), and any conflict of laws/rules leading to the application of laws other than the substantive laws of Denmark shall likewise apply.

Any dispute arising out of or in connection with purchase of Products on the Website, shall be settled by Denmark’s ordinary courts of law, and Copenhagen shall be the proper venue for any action resulting therefrom.

ERRORS AND INVALIDITY

Small Wonder makes reservations for typographical errors, changes in value added tax and duty rates, and late or defective delivery due to force majeure events.

Should any part of the Terms be deemed unlawful and invalid and thus not enforceable, this will not affect the validity and enforcement of the remainder of the Terms.
